1. Terms of Service

Welcome to Barry. These Terms of Service ("Terms") govern your access to and use of the Barry platform, API, and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

1.1 Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have your parent or guardian's consent. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

1.2 Account Registration

To access the Service, you must register for an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are solely responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately at support@barrius.io if you suspect unauthorized use.

1.3 Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable law
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Transmit malware, viruses, or any harmful code
  • Use the Service to process data of individuals without a proper legal basis
  • Scrape or crawl the Service without prior written permission

1.4 Intellectual Property

The Service, including its code, design, logos, documentation, and brand assets, is owned by Barry and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

1.5 User Content

You retain ownership of any data, text, or materials you submit to the Service ("User Content"). By submitting User Content, you grant Barry a non-exclusive, worldwide, royalty-free license to use, host, store, and process that content solely to provide and improve the Service. You represent that you have all rights necessary to grant this license.

1.6 Payment Terms

Access to certain Service features may require payment of fees. Fees are non-refundable except as expressly stated. We may change our fees with 30 days' notice. Late payments may result in suspension of access.

1.7 Limitation of Liability

To the maximum extent permitted by law, Barry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claims under these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.

1.8 Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

1.9 Termination

You may terminate your account at any time. We may suspend or terminate your access if you violate these Terms or applicable Model Terms. Upon termination, your right to use the Service ceases immediately. Sections 1.4, 1.5, 1.7, 1.8, and 1.10 through 1.13 survive termination.

1.10 Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in San Francisco County, California.

1.11 Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or through the Service 30 days in advance. Continued use after changes take effect constitutes your acceptance of the updated Terms.

2. Privacy Policy

Barry ("we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service.

2.1 Information We Collect

Account Information: When you register, we collect your name, email address, institution name, and role.

Usage Data: We automatically collect certain information when you use the Service, including IP address, browser type, pages visited, and timestamps of interactions. We use cookies and similar technologies for authentication, session management, and analytics.

Educational Data: As part of providing the Service, you may submit student records, course enrollments, grades, and related educational data. We process this data on your behalf as a data processor under your instructions.

  • Process transactions and manage accounts
  • Send important notices, security updates, and support messages
  • Comply with legal obligations

3. Model Terms

Barry may provide AI-powered features, including machine learning models, predictive analytics, and automated recommendation systems ("AI Features"). These Model Terms govern your access to and use of such features.

3.2 Nature of AI Features

AI Features are provided as supplementary tools to assist with educational administration. They generate outputs based on patterns in training data and your inputs. Outputs may not always be accurate, complete, or appropriate for your specific context. You are solely responsible for reviewing and validating any AI-generated output before relying on it for decisions affecting students, staff, or institutional operations.

3.3 Input and Output

  • Input: Data you provide to AI Features is processed solely to generate responses. We do not use your specific inputs to train or improve our underlying models beyond the scope necessary to fulfill your request.
  • Output: AI-generated content is provided "AS IS" without guarantees of accuracy or fitness for a particular purpose. Outputs may contain errors, omissions, or biases present in the underlying models.

3.4 Data Use and Model Improvement

We may use anonymized, aggregated usage data to improve our AI Features and the Service. We will not use your specific educational records, student data, or personal information for model training without obtaining your separate, informed consent. Where possible, we have opted our accounts out of model training by default.

3.5 Limitations and Disclaimers

  • AI Features may produce inaccurate, incomplete, or outdated results. You should independently verify critical information.
  • We make no warranty that AI Features will meet your requirements or be error-free, uninterrupted, or secure.
  • AI Features may reflect biases present in their training data. You are responsible for evaluating outputs for fairness, equity, and appropriateness in your educational context.
  • AI Features are not a substitute for professional judgment, especially in matters affecting student welfare, academic integrity, or legal compliance.

3.6 Prohibited Uses

You agree not to use AI Features to:

  • Make automated decisions that have legal or significant effects on individuals without appropriate human review
  • Process protected health information (PHI) subject to HIPAA without a proper business associate agreement in place
  • Generate discriminatory, harassing, defamatory, or otherwise harmful content
  • Attempt to extract, reverse engineer, or replicate the underlying models
  • Conduct red teaming, jailbreaking, or adversarial attacks on the AI Features
  • Use the AI Features in high-risk, safety-critical, or regulated environments without adequate safeguards

3.7 Transparency

Where AI-generated output is presented to end users — including students, parents, or staff — you agree to clearly and conspicuously disclose that the content was generated or assisted by AI. You should not represent AI-generated content as human-authored.

3.8 Availability and Changes

We do not guarantee the availability of any specific AI Feature. Models may be added, modified, or removed at any time. These Model Terms may be updated as AI Features evolve. Material changes will be notified via email or through the Service. Continued use of AI Features after updates constitutes acceptance of the revised Model Terms.

3.9 Provider Terms

AI Features may rely on third-party model providers. Your use of AI Features is also subject to the applicable third-party terms, which we make available for your review. You are responsible for ensuring your use complies with those terms.
